Legal and Contractual Status
The Financial Service Provider is a Private Company and is a duly authorised intermediary of the following product suppliers:
- Investec Bank
- Nedbank
- Capitec Bank
- Discovery Bank
No conditions or restrictions have been imposed by any of the above product suppliers. Our Family Office accepts responsibility for its own actions and for the actions of the intermediary that may be performed by him or her acting within the course and scope of the written agreement. Our Family office acts in accordance with the permissions of its licenses for transactions that fall under the remit of their licence in the various jurisdictions where they are licenced, as referenced below. Please note that all services marketed or distributed are not available in all jurisdiction. The services of Trustco Life is regulated in the borders of Namibia and the intermediary providing the offshore service within the borders of Namibia is Covest Wealth Managers. Covest Wealth Managers is registered with the Namibia Financial Institutions Supervisory Authority (NAMFISA) and is an authorised juristic Representative of Our Family Office, South Africa FSP50677 Financial Services for which Authorised.
In terms of the licence issued to Our Family Office by the Registrar, the financial service provider is authorised to provide intermediary services in respect of the following financial product categories. No conditions or restrictions have been imposed by the Registrar.

Please note that in terms of the Financial Intelligence Centre Act (FICA), we are an accountable institution under law and as such obliged to report suspicious and unusual transactions that may facilitate money laundering to the authorities.
Disclosure of Interest and Remuneration
Please note that the provider has established a Conflict of Interest Management policy which requires your intermediary to disclose any actual or potential conflict of interest to you. A copy of the Conflict of Interest Management Policy is available to the client at this office during office hours each day. Neither the provider nor your intermediary holds directly or indirectly more than 10% of any product supplier’s shares or an equivalent financial interest. Our Family Office has received more than 30% of the total remuneration from one provider.
General
The provider may from time to time receive non-cash incentives from product suppliers or indirect consideration from other persons. The provider will make available specific details should this occur.
Complaint Resolution System and Procedures
Should you be dissatisfied with any aspect of the service performed by the provider, you should address your complaint in writing to Kenne de Kock at kenne@ofo.co.za. Please note that we have established a written internal compliant resolution system with detailed procedures. Access to written procedures and a copy of the complaint resolution system is available to clients at this office during office hours each day.
Responsibility for Correctness and Completeness of Information
Please be aware when completing any documentation or providing any information, that all material facts must be accurately and properly disclosed. You are entirely responsible for the accuracy and completeness of all answers, statements or other information provided by you or on your behalf. Please note that all material facts in respect of any application, proposal, order, instruction or other contractual information that is required to be completed for or submitted to a product supplier by or on your behalf that relates to the purchase of or investment in any financial product, including any amendment thereof or variation thereto, must be accurately and properly disclosed. Any misrepresentation or non-disclosure of a material fact or the inclusion of incorrect information could result in the cancellation of the transaction by the product supplier.
Waiver of Rights
You are hereby advised that no financial advisor or any other person may ask you or offer any inducement to you to waive any right or benefit conferred on you by or in terms of any provision of the General Codes of Conduct. A copy of the Code of Conduct is available on request.
Signing of Incomplete Documents
You are hereby advised and cautioned that no person acting on behalf other than Our Family Office may request you to sign any written or printed form or document unless all details required to be inserted thereon by you or on your behalf have already been inserted.
POPI Act The Protection of Personal Information (POPI) Act requires us to inform you how we use, disclose and destroy personal information we obtain from you. We are committed to protecting your privacy and will ensure that your personal information is used appropriately, transparently, securely and according to applicable law. Your personal information may be collected, processed, recorded, used and must be safeguarded during the rendering of financial services to you by Our Family Office. The FSP may also add to your personal information, with information received from other product providers and third parties in order to offer a more comprehensive and appropriate service to you. The FSP may verify, share and disclose your personal information to their product providers, and third-parties whose services or products they use in order to adequately and appropriately render financial services. The FSP may also collect and processes your personal information for the FSP marketing purposes to ensure their products and services remain applicable and appropriate. You have the right to access the personal information which the FSP holds. You have the right to ask the FSP to update, correct or delete your personal information on reasonable grounds. Once you object to the FSP processing your personal information, the FSP may no longer process your personal information, within reasonable parameters, unless to conclude a transaction or outstanding business. Should you wish to withdraw your consent to process your personal information, you must do so in writing, addressed to the FSP Information Officer. Once you withdraw your consent for the FSP to process your personal information, you understand that the FSP is still obliged under other legislation to keep the information for 5 years after termination of the relationship between the FSP and yourself. The FSP may disclose your information where they have a duty or a right to disclose in terms of applicable legislation or where it may be necessary under any other law.
